Eligibility Criteria - Who can apply

An applicant from India is eligible to apply only if their partner/spouse: 

• Is a British or Irish Citizen by any mean

• Has a settled life in the UK with a status of permanent resident, EU resident, or indefinite leave to remain (ILR)

• Has protection status as a refugee or under humanitarian rights

• You and your spouse must be over 18 years

• You must be legally married, and marriage should also be recognized in the UK

How to meet Spouse VISA Requirements?

1. Genuine Relationship: To show your genuine relationship with your partner, applicants must have a valid marriage certificate to attach to the online application. Your marriage must be two years old. So, submit sufficient proof to strengthen your visa file. 

2. Financial Requirements: Applicants must have a minimum annual income of approximately $18,600, which can include the combined income of the principal applicant and their UK-based spouse. Sources of income can be the following:

• Employment or self-employment 

• Pension of applicant or partner

• Maternity benefits offered to UK-partner by the government

• Saving or FD of couples

3. English Language proficiency: Having sufficient English skills is mandatory to apply for a spouse visa. Candidate must have at least A1 level of English on the CEFR (Common European Framework of Reference for Languages) scale. Academics studied in English medium are also sufficient to prove English proficiency. 

4. Accommodation: Applicants must show their arranged accommodation in the UK. Usually, applicants can show their partner’s living space as an option for accommodation.

Applicants need to pay $1,538 to submit their online application from India. Other costs may also include healthcare fees ($624), biometrics ($19.20), and more. It usually takes 24 weeks to process the application. Applicants can also take super priority service for the visa result in just one or two working days. When to Apply for ILR

Once you obtain your spouse visa and stay in the UK for a minimum of 5 years, you are eligible to apply for ILR. It means you stay in the country permanently with no immigration restrictions.
